The Federal High Court in Abuja has ordered that court documents be served on former presidential candidate of the African Democratic Congress, Prof. Pat Utomi, via courier, in a suit filed by the Department of State Services (DSS) over his alleged plan to establish a “shadow government” in Nigeria.
Justice James Omotosho granted the ex parte motion filed by DSS counsel, Akinlolu Kehinde (SAN), seeking leave to serve Utomi at his Lagos residence.
In the suit marked FHC/ABJ/CS/937/2025, dated May 13, the DSS is asking the court to declare the proposed shadow cabinet by Utomi and his associates unconstitutional, arguing it amounts to forming a parallel government not recognised by the Nigerian Constitution.
The agency is also seeking a perpetual injunction to restrain Utomi and his associates from taking any further steps toward establishing or operating the alleged shadow government.
Citing Sections 1 and 14 of the Constitution, the DSS argued that the initiative undermines Nigeria’s constitutional democracy, threatens national security, and could incite political unrest.
In its supporting affidavit, the DSS claimed Utomi publicly announced the formation of a shadow government via social media and press statements, assigning positions such as “Ombudsman” and members of a “Policy Delivery Unit.”
The agency said the move could mislead the public, erode confidence in the legitimate government, and potentially embolden separatist groups.
Justice Omotosho approved the service of the court documents via courier and adjourned the matter to June 25 for hearing.
