The Lagos State Government has lauded the landmark decision by the Supreme Cort of Nigeria in Suit No. SC/1/2008, which nullified the National Lottery Act and reaffirmed the constitutional right of State Governments to regulate lotteries and gaming activities within their jurisdictions.
In a statement issued on behalf of the State Government, the Commissioner for Information and Strategy, Gbenga Omotoso, described the ruling as a historic victory for the rule of law, federalism, and the constitutional rights of states. The Supreme Court’s decision, he said, is a major affirmation that the regulation of lotteries and gaming is a residual matter, firmly under the authority of state governments, and falls outside federal control.
“This judgment is a significant endorsement of true federalism, empowering states to regulate activities within their own territories in a manner that reflects their unique needs and circumstances,” Omotoso said. “It is also a vindication of the longstanding belief of President Bola Ahmed Tinubu regarding the need for true federalism in Nigeria, a vision that is now taking shape under his leadership.”
The statement went on to acknowledge the pivotal role played by former Governor Babatunde Raji Fashola, SAN, who initiated the legal challenge on behalf of the state. Omotoso commended Fashola for his unwavering commitment to testing contentious constitutional issues in court, noting that his courage and persistence were key to securing the outcome.
“Governor Fashola’s determination to follow through with this case has brought the nation to a new dawn of clarity, and we owe him a great debt for his leadership on this matter,” Omotoso continued. “The steadfast leadership of Governor Babajide Sanwo-Olu, whose administration has consistently upheld the rule of law, has been critical in securing this momentous victory for Lagos and the nation.”
The Lagos State Government emphasized that, as a result of the Supreme Court’s ruling, the Lagos State Lotteries and Gaming Authority (LSLGA) remains the sole regulatory body for lotteries and gaming within Lagos State. The authority will continue to oversee the industry, ensuring that all gaming activities are conducted in a transparent, responsible, and internationally compliant manner.
The government also issued a strong warning to all illegal and unlicensed lottery and gaming operators, urging them to immediately approach the LSLGA for regularization or face legal action. “We are committed to providing a conducive environment for legitimate operators and safeguarding our residents from the risks posed by unregulated gaming activities,” Omotoso stated.
In conclusion, he reaffirmed the Lagos State Government’s commitment to fostering a business-friendly environment for licensed gaming operators and ensuring that the sector contributes to the state’s economic growth and the well-being of its citizens. “Lagos will continue to be a leader in promoting a regulated, responsible gaming industry that supports the state’s prosperity,” Omotoso added.
